Lunsford Will Not Prosecute Anti-Western Bypass Group

Albemarle Commonwealth’s Attorney Denise Lunsford (pictured) says she will not prosecute an anti-western bypass group concerning pre-election advertising. Bypass supporter Rivanna District Supervisor Ken Boyd raised concerns regarding advertising by the group known as the Charlottesville Bypass Truth Coalition prior to the November 5th election. Boyd requested an investigation of the tax and registration status of the group. Boyd wanted Lunsford to determine if the group could legally run anti-western bypass advertisements. Lunsford says she did not find that the Coalition or CATCo (Charlottesville-Albemarle Transportation Coalition) is a Political Action Committee. She says she found no evidence to support the argument that its primarv purpose is, or was, to advocate the election or defeat of clearly identified candidates. Lunsford says CATCo should have filed an Independent Expenditure Report in one set of ads. But Lunsford concludes that she’s declining to prosecute the entire matter.
