Same Sex Marriage Cases Moving Forward

Several civil rights groups have now filed motions to challenge the constitutionality of Virginia’s same sex marriage ban. Two of those asked a federal court in the Western District of Virginia for a swift resolution concerning two lesbian couples who have been legally married elsewhere. Claire GastaƱaga, the Executive Director of the ACLU of Virginia, says a single, federal trial judge will decide the motion and if he or she rules against it, the issue would go to trial. The defendants in the case are parties who act on behalf of the Commonwealth; the state registrar, the clerk of the court and the attorney general’s office.
The two attorneys who got California’s ban on gay marriage overturned also filed lawsuits in Virginia.
