Culpeper County Sheriff Scott Jenkins’ motion to dismiss one of the counts against him in a wrongful conviction lawsuit has failed. Jenkins is accused of hiding evidence during the investigation into the murder of 74-year-old Thelma Scroggins. The judge cited an earlier ruling that identified at least three instances of improper concealment of evidence by the investigators. Michael Hash’s conviction for the murder was overturned in 2012, citing police and prosecutorial misconduct. Hash then sued Jenkins, a former prosecutor and several others. Hash was 15 at the time of Scroggins’ death. He was convicted in 2001 and served 12 years of a life sentence.
